Judge Pate Denies Immunity – Huntsville Police Officer William Darby To Face Justice

adison County Circuit Court Judge Donna Pate today has denied Huntsville Police Officer William Darby’s request for immunity in the shooting death of suicidal Jeffrey Parker in April of 2018. Other actions in the case have been stayed pending Darby’s decision whether to appeal this decision.
Madison County County District attorney Rob Broussard made the determination to bring the murder charges against the Huntsville police officer.

This is a case that still leaves many questions unanswered not the least of which are the true motivation of Huntsville Mayor Tommy Battle and the City Council in providing up to $125,000 for William Darby’s defense. It may seem the right thing to do, but the city may have a substantial liability for Darby’s lack of training, and systemic corruption in the Huntsville Police Dept.

It does appear Darby was “acting out” in a manner that may have been part of his preemployment conditioning, or inappropriate training by the Huntsville Police Dept. However, that would not absolve him of his own illegal behavior, even as a police officer. Ipso facto, Police Department policy isn’t necessarily based on legitimate law. Tommy Battle has been made aware that this will be a problem until and unless he takes the proactive steps to disrupt the employment streams that come from the affinity cults who indoctrinate future candidates for police officer. Both police officers William Eric Freeman and Danny Golden, who were killed on duty, also appear to have fallen victim to this systemic corruption.

The bottom line is killing another person is serious no matter the circumstances and if there is any question about whether Officer Darby was acting legally in killing Jeffrey Parker it should be reviewed and determined by a jury. It is unfortunate that Police Officers do not appear to receive just scrutiny as evidenced in other high profile cases where officers were clearly using illegal excessive force but faced no consequences. No matter, suicidal or not, Jeffrey Parker deserves to have William Darby’s day in court.
